生(sheng)態(tai)環(huan)(huan)境(jing)分區(qu)管(guan)控(kong)(kong)是以(yi)保(bao)(bao)障生(sheng)態(tai)功能(neng)和(he)改(gai)善環(huan)(huan)境(jing)質量(liang)為目(mu)標,實(shi)施分區(qu)域差異化精準管(guan)控(kong)(kong)的(de)環(huan)(huan)境(jing)管(guan)理(li)制度,是提(ti)升生(sheng)態(tai)環(huan)(huan)境(jing)治理(li)現(xian)代(dai)化水平的(de)重要舉(ju)措。實(shi)施生(sheng)態(tai)環(huan)(huan)境(jing)分區(qu)管(guan)控(kong)(kong),嚴(yan)守生(sheng)態(tai)保(bao)(bao)護(hu)(hu)紅線、環(huan)(huan)境(jing)質量(liang)底線、資源利用上線,科(ke)學(xue)指導各類(lei)開發(fa)保(bao)(bao)護(hu)(hu)建設(she)活動,對于(yu)推(tui)動高質量(liang)發(fa)展,建設(she)人與(yu)自然(ran)和(he)諧共(gong)生(sheng)的(de)現(xian)代(dai)化具有重要意(yi)義。為加強(qiang)生(sheng)態(tai)環(huan)(huan)境(jing)分區(qu)管(guan)控(kong)(kong),經黨中央、國務院同意(yi),現(xian)提(ti)出(chu)如(ru)下意(yi)見。
一(yi)、總體要求
加強(qiang)生(sheng)態環境(jing)(jing)分區管控,要堅持以習(xi)近平新(xin)(xin)時(shi)代中國(guo)特色社會(hui)主義(yi)思(si)想(xiang)特別是習(xi)近平生(sheng)態文(wen)明思(si)想(xiang)為指導(dao),深入貫徹黨的(de)二(er)十大精神,落(luo)實全(quan)(quan)國(guo)生(sheng)態環境(jing)(jing)保護大會(hui)部署,完整、準確、全(quan)(quan)面貫徹新(xin)(xin)發展理念,加快構建新(xin)(xin)發展格局,協同(tong)推(tui)進降碳、減污、擴綠(lv)、增長,充分尊重自然規律和(he)區域差異,全(quan)(quan)面落(luo)實主體功能區戰略(lve),充分銜接國(guo)土空間規劃和(he)用途管制,以高水平保護推(tui)動高質量發展、創造高品質生(sheng)活,努力建設人(ren)與自然和(he)諧(xie)共生(sheng)的(de)美麗中國(guo)。
——生(sheng)態(tai)(tai)優先,綠色(se)發展。堅持尊重自(zi)(zi)(zi)然、順應(ying)自(zi)(zi)(zi)然、保護(hu)自(zi)(zi)(zi)然,守(shou)住自(zi)(zi)(zi)然生(sheng)態(tai)(tai)安全(quan)邊(bian)界(jie)和(he)環境質量底線,落實自(zi)(zi)(zi)然生(sheng)態(tai)(tai)安全(quan)責任,推進綠色(se)低(di)碳發展。
——源頭預(yu)防(fang)(fang),系統(tong)保護。健全生態環(huan)境源頭預(yu)防(fang)(fang)體系,統(tong)籌山水林田湖(hu)草沙一體化保護和系統(tong)治(zhi)理(li),加強生物(wu)多(duo)樣性保護,強化多(duo)污染物(wu)協同控制和區(qu)域協同治(zhi)理(li)。
——精準科學,依(yi)法管(guan)控。聚焦區(qu)域(yu)性、流(liu)域(yu)性突出生態環(huan)境問題,精準科學施策(ce),依(yi)法依(yi)規建立從問題識別到解決方(fang)案(an)的分區(qu)分類管(guan)控策(ce)略。
——明確責任(ren),協(xie)調(diao)聯動。國家層面(mian)做(zuo)好頂(ding)層設計(ji),地(di)方黨委和政府落實主體(ti)責任(ren),有關部門加(jia)強溝通協(xie)調(diao),建立分(fen)工協(xie)作(zuo)(zuo)工作(zuo)(zuo)機制,提高(gao)政策(ce)統(tong)一性(xing)、規則一致(zhi)性(xing)、執行協(xie)同(tong)性(xing)。
到2025年(nian),生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)分區(qu)管(guan)控(kong)制度基本(ben)建(jian)立,全域覆蓋、精準科學的(de)生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)分區(qu)管(guan)控(kong)體系初步形成。到2035年(nian),體系健全、機制順暢、運行高效的(de)生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)分區(qu)管(guan)控(kong)制度全面建(jian)立,為生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)根本(ben)好轉、美(mei)麗中國目標基本(ben)實現提供(gong)有力支撐(cheng)。
二、全面推進生態環境分(fen)區管控
(一(yi))制(zhi)(zhi)定生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)分(fen)(fen)區(qu)管(guan)(guan)控方案(an)(an)(an)。深(shen)入實施(shi)主體(ti)功能(neng)區(qu)戰(zhan)略,全(quan)面落(luo)實《全(quan)國(guo)國(guo)土(tu)空間規(gui)劃綱要(2021-2035年(nian))》,制(zhi)(zhi)定以(yi)(yi)落(luo)實生(sheng)(sheng)態(tai)保護紅線、環(huan)(huan)境(jing)(jing)(jing)質量底線、資源利(li)用上線硬約束為重點(dian),以(yi)(yi)生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)管(guan)(guan)控單元為基礎,以(yi)(yi)生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)準入清單為手段(duan),以(yi)(yi)信息平臺(tai)為支撐的(de)生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)分(fen)(fen)區(qu)管(guan)(guan)控方案(an)(an)(an)。堅持國(guo)家指(zhi)導、省級(ji)統(tong)籌(chou)、市級(ji)落(luo)地的(de)原則,分(fen)(fen)級(ji)編制(zhi)(zhi)發布(bu)本行政區(qu)域內生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)分(fen)(fen)區(qu)管(guan)(guan)控方案(an)(an)(an)。省級(ji)、市級(ji)生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)分(fen)(fen)區(qu)管(guan)(guan)控方案(an)(an)(an)由同級(ji)政府組(zu)織編制(zhi)(zhi),充分(fen)(fen)做好與國(guo)土(tu)空間規(gui)劃“一(yi)張圖”系統(tong)的(de)銜接(jie),報上一(yi)級(ji)生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)(jing)(jing)主管(guan)(guan)部(bu)門備案(an)(an)(an)后發布(bu)實施(shi)。
(二)確(que)定(ding)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環(huan)境(jing)(jing)(jing)管(guan)控(kong)(kong)單(dan)(dan)元。基于生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環(huan)境(jing)(jing)(jing)結構、功能、質量等區(qu)域(yu)(yu)特征,通過環(huan)境(jing)(jing)(jing)評價(jia),在大(da)氣、水、土壤(rang)、生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)、聲、海洋等各(ge)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環(huan)境(jing)(jing)(jing)要素管(guan)理分(fen)區(qu)的(de)基礎上,落實“三(san)區(qu)三(san)線(xian)”劃(hua)定(ding)成(cheng)果(guo),以(yi)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)保(bao)(bao)護紅線(xian)為基礎,把該保(bao)(bao)護的(de)區(qu)域(yu)(yu)劃(hua)出(chu)來,確(que)定(ding)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環(huan)境(jing)(jing)(jing)優先(xian)保(bao)(bao)護單(dan)(dan)元;以(yi)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環(huan)境(jing)(jing)(jing)質量改(gai)善壓力大(da)、資源能源消耗強度高、污染物排放集中、生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)破壞(huai)嚴(yan)重(zhong)、環(huan)境(jing)(jing)(jing)風(feng)險(xian)高的(de)區(qu)域(yu)(yu)為主體,把發展(zhan)同保(bao)(bao)護矛盾突出(chu)的(de)區(qu)域(yu)(yu)識(shi)別出(chu)來,確(que)定(ding)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環(huan)境(jing)(jing)(jing)重(zhong)點管(guan)控(kong)(kong)單(dan)(dan)元;生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環(huan)境(jing)(jing)(jing)優先(xian)保(bao)(bao)護單(dan)(dan)元和生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環(huan)境(jing)(jing)(jing)重(zhong)點管(guan)控(kong)(kong)單(dan)(dan)元以(yi)外的(de)其他(ta)區(qu)域(yu)(yu)實施一般管(guan)控(kong)(kong)。
(三)編制(zhi)生(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)準入(ru)(ru)清單(dan)。落實(shi)市(shi)場準入(ru)(ru)負面清單(dan),根據生(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)功能(neng)定(ding)位和國土空間用(yong)(yong)途管制(zhi)要求(qiu),聚焦(jiao)解(jie)決突(tu)出(chu)(chu)生(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)問題,系統集成現有生(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)管理規定(ding),精準編制(zhi)差別化生(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)準入(ru)(ru)清單(dan),提出(chu)(chu)管控污染物(wu)排放、防(fang)控環(huan)(huan)(huan)境(jing)風險、提高資源能(neng)源利用(yong)(yong)效率(lv)等(deng)要求(qiu)。因地制(zhi)宜(yi)實(shi)施“一(yi)單(dan)元(yuan)一(yi)策略”的(de)精細化管理,生(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)優先(xian)保護(hu)單(dan)元(yuan)要加強(qiang)生(sheng)態(tai)(tai)(tai)系統保護(hu)和功能(neng)維護(hu),生(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)重點管控單(dan)元(yuan)要針對(dui)突(tu)出(chu)(chu)生(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)問題強(qiang)化污染物(wu)排放管控和環(huan)(huan)(huan)境(jing)風險防(fang)控,其他區域(yu)要保持生(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)質量(liang)基本穩定(ding)。生(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)質量(liang)改善壓力(li)大、問題和風險突(tu)出(chu)(chu)的(de)地方(fang),要制(zhi)定(ding)更為精準的(de)管控要求(qiu)。
(四(si))加強生(sheng)態環境(jing)(jing)分區(qu)管(guan)控信(xin)息(xi)共享。推(tui)進國(guo)家和(he)省級生(sheng)態環境(jing)(jing)分區(qu)管(guan)控系統(tong)與其他業(ye)務(wu)(wu)系統(tong)的(de)信(xin)息(xi)共享、業(ye)務(wu)(wu)協同,強化(hua)對數據管(guan)理、調(diao)整(zheng)更新(xin)、實(shi)施應用、跟蹤評估(gu)、監督(du)管(guan)理的(de)支(zhi)撐(cheng)作用。推(tui)進新(xin)一(yi)代信(xin)息(xi)技術、人(ren)工智能等與生(sheng)態環境(jing)(jing)分區(qu)管(guan)控融合創新(xin),完善在(zai)線政務(wu)(wu)服務(wu)(wu)和(he)智慧決(jue)策(ce)功(gong)能,提升服務(wu)(wu)效能。
(五)統籌(chou)開(kai)展(zhan)定(ding)期(qi)調(diao)整(zheng)與動(dong)態(tai)(tai)更(geng)新(xin)。生(sheng)態(tai)(tai)環(huan)境分(fen)區管(guan)控方案原則(ze)上(shang)保持穩定(ding),每5年結(jie)合國(guo)民(min)經濟(ji)(ji)和(he)(he)社會發(fa)展(zhan)規(gui)劃(hua)、國(guo)土空(kong)間(jian)規(gui)劃(hua)評估情況定(ding)期(qi)調(diao)整(zheng)。5年內確需更(geng)新(xin)的(de),按(an)照“誰發(fa)布、誰更(geng)新(xin)”的(de)原則(ze),在充(chong)分(fen)銜(xian)接國(guo)民(min)經濟(ji)(ji)和(he)(he)社會發(fa)展(zhan)規(gui)劃(hua)、國(guo)土空(kong)間(jian)規(gui)劃(hua)的(de)基礎上(shang),開(kai)展(zhan)動(dong)態(tai)(tai)更(geng)新(xin),同時(shi)報上(shang)一級生(sheng)態(tai)(tai)環(huan)境主(zhu)管(guan)部門備案。因(yin)重大戰略、生(sheng)態(tai)(tai)環(huan)境保護(hu)(hu)目標等發(fa)生(sheng)變化而更(geng)新(xin)的(de),應(ying)組織科學論(lun)證;生(sheng)態(tai)(tai)保護(hu)(hu)紅線、飲用水水源保護(hu)(hu)區、自然保護(hu)(hu)地等法(fa)定(ding)保護(hu)(hu)區域依法(fa)依規(gui)設立、調(diao)整(zheng)或撤并以及(ji)法(fa)律法(fa)規(gui)有新(xin)規(gui)定(ding)的(de),相應(ying)進行同步(bu)更(geng)新(xin)。
三、助(zhu)推經(jing)濟社會高質(zhi)量發展
(六)服(fu)務國(guo)家重大戰(zhan)略。通過生(sheng)態(tai)環(huan)境(jing)(jing)分區(qu)管(guan)控(kong),加強整體(ti)性(xing)保(bao)護(hu)和(he)系統(tong)性(xing)治理,支撐(cheng)優化(hua)(hua)重大生(sheng)產(chan)力(li)布(bu)局,服(fu)務國(guo)家重大基礎設施建設,保(bao)障(zhang)國(guo)家重大戰(zhan)略實(shi)施。落(luo)實(shi)長江(jiang)(jiang)經濟帶發展(zhan)(zhan)戰(zhan)略,推動(dong)長江(jiang)(jiang)全流域按單元(yuan)精細化(hua)(hua)分區(qu)管(guan)控(kong),加強沿江(jiang)(jiang)重化(hua)(hua)工(gong)業水污(wu)染防(fang)治和(he)環(huan)境(jing)(jing)風險(xian)防(fang)控(kong),防(fang)止重污(wu)染企業和(he)項目向長江(jiang)(jiang)中(zhong)(zhong)上(shang)游轉移。落(luo)實(shi)黃(huang)河流域生(sheng)態(tai)保(bao)護(hu)和(he)高質量發展(zhan)(zhan)戰(zhan)略,實(shi)施上(shang)中(zhong)(zhong)下(xia)游地區(qu)差異化(hua)(hua)分區(qu)管(guan)控(kong),優化(hua)(hua)黃(huang)河中(zhong)(zhong)上(shang)游能源(yuan)化(hua)(hua)工(gong)和(he)新(xin)能源(yuan)產(chan)業布(bu)局,促進(jin)中(zhong)(zhong)下(xia)游產(chan)業綠色(se)低碳循環(huan)發展(zhan)(zhan)。強化(hua)(hua)生(sheng)態(tai)環(huan)境(jing)(jing)分區(qu)管(guan)控(kong)在京津冀、長三角(jiao)、粵港澳大灣區(qu)產(chan)業、能源(yuan)和(he)交通運輸結構調(diao)整中(zhong)(zhong)的應用,建立陸岸海聯動(dong)、區(qu)域一體(ti)化(hua)(hua)的生(sheng)態(tai)環(huan)境(jing)(jing)管(guan)控(kong)機制,引導傳統(tong)制造業綠色(se)低碳轉型升級及戰(zhan)略性(xing)新(xin)興產(chan)業合(he)理布(bu)局。
(七(qi))促進綠(lv)色低(di)(di)碳發展。落實國家(jia)(jia)高(gao)耗能(neng)、高(gao)排放(fang)、低(di)(di)水平項目(mu)管(guan)(guan)理有關(guan)制度和(he)政(zheng)策要求,引(yin)導(dao)重點行業(ye)向環(huan)境容量大(da)、市場需求旺(wang)盛、市場保障(zhang)條件好的地(di)區科(ke)學布(bu)局、有序轉移。強化生(sheng)(sheng)態(tai)(tai)環(huan)境重點管(guan)(guan)控單元管(guan)(guan)理,推進石(shi)化化工、鋼鐵、建(jian)(jian)材等傳統(tong)產(chan)業(ye)綠(lv)色低(di)(di)碳轉型升級和(he)清潔生(sheng)(sheng)產(chan)改造。完善產(chan)業(ye)園(yuan)區環(huan)境基礎設(she)(she)施(shi)(shi)建(jian)(jian)設(she)(she),推動產(chan)業(ye)集(ji)聚發展和(he)集(ji)中治(zhi)污(wu)。銜(xian)接生(sheng)(sheng)態(tai)(tai)環(huan)境準入清單,引(yin)導(dao)人口密度較高(gao)的中心城區傳統(tong)產(chan)業(ye)功能(neng)空間有序騰退。優化生(sheng)(sheng)態(tai)(tai)環(huan)境優先保護單元管(guan)(guan)理,鼓勵探索生(sheng)(sheng)態(tai)(tai)產(chan)品價值實現模(mo)式和(he)路徑(jing),提(ti)升生(sheng)(sheng)態(tai)(tai)碳匯能(neng)力。在保證生(sheng)(sheng)態(tai)(tai)系統(tong)多樣性(xing)(xing)、穩定性(xing)(xing)、持續性(xing)(xing)的前(qian)提(ti)下,支持國家(jia)(jia)重大(da)戰略(lve)、重大(da)基礎設(she)(she)施(shi)(shi)、民(min)生(sheng)(sheng)保障(zhang)等項目(mu)建(jian)(jian)設(she)(she)。實施(shi)(shi)好沙漠、戈壁、荒漠地(di)區大(da)型風電(dian)和(he)光伏基地(di)建(jian)(jian)設(she)(she)。
(八)支撐(cheng)綜合決(jue)(jue)策。加(jia)強生態環(huan)境(jing)(jing)分區(qu)(qu)管(guan)控成(cheng)果(guo)應(ying)用,為地方黨委和政(zheng)府提供決(jue)(jue)策支撐(cheng)。把生態環(huan)境(jing)(jing)分區(qu)(qu)管(guan)控實(shi)施成(cheng)效(xiao)評(ping)估(gu)作(zuo)為優化環(huan)境(jing)(jing)影(ying)響評(ping)價管(guan)理的(de)重(zhong)要依(yi)據(ju)。加(jia)強生態環(huan)境(jing)(jing)分區(qu)(qu)管(guan)控對企業投資的(de)引導,在生態環(huan)境(jing)(jing)分區(qu)(qu)管(guan)控信息(xi)平臺依(yi)法(fa)依(yi)規設置公(gong)共(gong)查閱(yue)權限,方便(bian)企業分析項目與生態環(huan)境(jing)(jing)分區(qu)(qu)管(guan)控要求的(de)符合性,激發經營(ying)主體發展活力(li)。
四、實(shi)施生態(tai)環境高水平保護
(九)維護(hu)生(sheng)態(tai)安(an)全格局。嚴(yan)格落實生(sheng)態(tai)保(bao)護(hu)紅線(xian)管控(kong)要求。以(yi)生(sheng)態(tai)保(bao)護(hu)紅線(xian)為重點(dian),改善生(sheng)態(tai)系(xi)(xi)統質量,提升生(sheng)態(tai)系(xi)(xi)統穩定性和服務功能。強化生(sheng)物多樣(yang)性保(bao)護(hu),健全生(sheng)物多樣(yang)性保(bao)護(hu)網絡。加強監測預(yu)警(jing),主動適應氣候變(bian)化。對(dui)青(qing)藏高原生(sheng)態(tai)屏障區(qu)、黃河(he)重點(dian)生(sheng)態(tai)區(qu)、長江(jiang)重點(dian)生(sheng)態(tai)區(qu)和東北森林帶、北方防沙帶、南方丘陵山地帶、海岸帶等(deng)重點(dian)區(qu)域,分單(dan)元(yuan)識別突出環(huan)境問(wen)題,落實環(huan)境治理差異化管控(kong)要求。
(十)推動環(huan)(huan)境(jing)質量改善。強化(hua)(hua)生(sheng)(sheng)態環(huan)(huan)境(jing)分(fen)(fen)區管(guan)(guan)控(kong)(kong)實施,形(xing)成(cheng)問題(ti)識別、精準溯(su)源、分(fen)(fen)區施策的工作閉環(huan)(huan),推動解決突出生(sheng)(sheng)態環(huan)(huan)境(jing)問題(ti),防范結構(gou)性、布(bu)(bu)局(ju)性環(huan)(huan)境(jing)風險,為高質量發展(zhan)騰出容量、拓展(zhan)空(kong)間。深(shen)化(hua)(hua)流(liu)域水(shui)(shui)(shui)(shui)環(huan)(huan)境(jing)分(fen)(fen)區管(guan)(guan)控(kong)(kong),統籌(chou)水(shui)(shui)(shui)(shui)資源、水(shui)(shui)(shui)(shui)環(huan)(huan)境(jing)、水(shui)(shui)(shui)(shui)生(sheng)(sheng)態治(zhi)(zhi)理(li),強化(hua)(hua)流(liu)域內水(shui)(shui)(shui)(shui)源涵(han)養區、河(he)湖水(shui)(shui)(shui)(shui)域及其(qi)緩沖帶等重要(yao)水(shui)(shui)(shui)(shui)生(sheng)(sheng)態空(kong)間管(guan)(guan)理(li),加強農(nong)業面源污(wu)染(ran)防治(zhi)(zhi)。加強近岸海(hai)(hai)域生(sheng)(sheng)態環(huan)(huan)境(jing)分(fen)(fen)區管(guan)(guan)控(kong)(kong),陸海(hai)(hai)統籌(chou)推進重點河(he)口海(hai)(hai)灣管(guan)(guan)理(li)。綜合(he)考慮大氣區域傳輸規(gui)律(lv)和(he)空(kong)間布(bu)(bu)局(ju)敏感性等,強化(hua)(hua)分(fen)(fen)區分(fen)(fen)類差異化(hua)(hua)協(xie)同管(guan)(guan)控(kong)(kong)。按照(zhao)土壤污(wu)染(ran)程度和(he)相關(guan)標(biao)準,實施農(nong)用(yong)地(di)分(fen)(fen)類管(guan)(guan)理(li)和(he)建(jian)設用(yong)地(di)準入管(guan)(guan)理(li)。加強聲環(huan)(huan)境(jing)管(guan)(guan)理(li),推動大型交通基礎設施、工業集(ji)中區等與噪(zao)聲敏感建(jian)筑(zhu)物集(ji)中區域用(yong)地(di)布(bu)(bu)局(ju)協(xie)調。探(tan)索開展(zhan)地(di)下(xia)水(shui)(shui)(shui)(shui)污(wu)染(ran)防治(zhi)(zhi)分(fen)(fen)區管(guan)(guan)控(kong)(kong)模式,統籌(chou)地(di)上(shang)地(di)下(xia),制定差別化(hua)(hua)的生(sheng)(sheng)態環(huan)(huan)境(jing)準入和(he)污(wu)染(ran)風險管(guan)(guan)控(kong)(kong)要(yao)求(qiu)。
(十一)強化(hua)生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)保護政(zheng)(zheng)策(ce)協同(tong)(tong)。發揮生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)在源頭(tou)預防體系(xi)中(zhong)的(de)基礎性作(zuo)用,實(shi)現(xian)全(quan)(quan)域(yu)覆蓋、跨(kua)部(bu)門協同(tong)(tong)、多要素綜(zong)合(he)的(de)精細(xi)化(hua)管(guan)(guan)(guan)(guan)理。加強生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)與(yu)(yu)國(guo)土空間規劃(hua)的(de)動(dong)(dong)(dong)態(tai)(tai)(tai)銜接,針對不同(tong)(tong)區(qu)(qu)(qu)域(yu)開發保護建設活動(dong)(dong)(dong)的(de)特點(dian),聚焦生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)質量改(gai)善(shan),實(shi)施分單元差(cha)異(yi)化(hua)的(de)生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)管(guan)(guan)(guan)(guan)理,生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)主管(guan)(guan)(guan)(guan)部(bu)門和自(zi)然資源主管(guan)(guan)(guan)(guan)部(bu)門要選擇(ze)典型地區(qu)(qu)(qu)開展試點(dian)、積累經驗(yan)、完(wan)善(shan)機制,形成政(zheng)(zheng)策(ce)合(he)力。開展生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)減污降碳協同(tong)(tong)試點(dian),研究(jiu)落實(shi)以碳排(pai)放(fang)、污染物排(pai)放(fang)等(deng)為依據(ju)的(de)差(cha)別化(hua)調(diao)(diao)控(kong)(kong)政(zheng)(zheng)策(ce)。強化(hua)生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)保護相關政(zheng)(zheng)策(ce)與(yu)(yu)生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)制度的(de)協同(tong)(tong),將生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)要求納入生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)有關標準、政(zheng)(zheng)策(ce)等(deng)制定修訂中(zhong)。鼓(gu)勵各地以產業(ye)園區(qu)(qu)(qu)、自(zi)由貿易試驗(yan)區(qu)(qu)(qu)等(deng)為重點(dian),開展生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)與(yu)(yu)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)影響評價、排(pai)污許可、環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)測、執法監(jian)管(guan)(guan)(guan)(guan)等(deng)協調(diao)(diao)聯動(dong)(dong)(dong)改(gai)革試點(dian),探索構建全(quan)(quan)鏈條生(sheng)(sheng)(sheng)態(tai)(tai)(tai)環(huan)(huan)(huan)境(jing)(jing)(jing)(jing)管(guan)(guan)(guan)(guan)理體系(xi)。
五(wu)、加強監督考核
(十二)強化監(jian)督(du)管(guan)理。有關(guan)部門要按(an)照職責分(fen)工,依(yi)托(tuo)相關(guan)監(jian)管(guan)平(ping)臺,充分(fen)利用大數(shu)據、衛星遙感、無人機等技術手段開展動態(tai)(tai)(tai)監(jian)控,對(dui)發現(xian)的(de)(de)突出(chu)問題和風險隱患開展現(xian)場檢查(cha)并嚴格依(yi)法查(cha)處。對(dui)生(sheng)態(tai)(tai)(tai)功能明顯降(jiang)低的(de)(de)生(sheng)態(tai)(tai)(tai)環境(jing)優(you)先保護(hu)單元(yuan)、生(sheng)態(tai)(tai)(tai)環境(jing)問題突出(chu)的(de)(de)生(sheng)態(tai)(tai)(tai)環境(jing)重點(dian)管(guan)控單元(yuan)以及環境(jing)質(zhi)量明顯下降(jiang)的(de)(de)其他區域,加強監(jian)管(guan)執法,依(yi)法依(yi)規推動限期整改。將生(sheng)態(tai)(tai)(tai)環境(jing)分(fen)區管(guan)控制(zhi)度落實中存(cun)在的(de)(de)突出(chu)問題納(na)入中央和省(sheng)級生(sheng)態(tai)(tai)(tai)環境(jing)保護(hu)督(du)察。
(十三(san))完善(shan)考(kao)核(he)評價。將生態(tai)環境(jing)分區管(guan)控實施情(qing)況(kuang)納入污染(ran)防治攻堅戰成效(xiao)考(kao)核(he)等,考(kao)核(he)結果作(zuo)為(wei)地方(fang)領(ling)導(dao)(dao)班子和(he)有關(guan)(guan)領(ling)導(dao)(dao)干部(bu)綜合考(kao)核(he)評價、獎懲任免(mian)的重(zhong)要參考(kao)。國務院(yuan)生態(tai)環境(jing)主管(guan)部(bu)門會同有關(guan)(guan)部(bu)門對工作(zuo)落(luo)實情(qing)況(kuang)進行(xing)跟蹤了解,工作(zuo)成效(xiao)作(zuo)為(wei)“綠(lv)水青(qing)山就(jiu)是金山銀山”實踐創新基(ji)地建設等的重(zhong)要參考(kao)。
六、組織保障
(十四)加(jia)強組(zu)織領導。堅持(chi)黨(dang)對(dui)生態環(huan)境分區管控(kong)工作(zuo)(zuo)的領導。地(di)方各(ge)(ge)級黨(dang)委和政府要(yao)嚴(yan)格落實生態環(huan)境保護“黨(dang)政同責(ze)、一崗雙責(ze)”,完(wan)善工作(zuo)(zuo)推(tui)進(jin)機制(zhi),定期研究(jiu)生態環(huan)境分區管控(kong)工作(zuo)(zuo),常(chang)態化推(tui)進(jin)共(gong)享共(gong)用、調整更新、監督落實等事項,及(ji)時報告重要(yao)工作(zuo)(zuo)進(jin)展,形成上下(xia)聯(lian)動、各(ge)(ge)司(si)其(qi)職、齊抓共(gong)管的良好格局。各(ge)(ge)地(di)區可結合實際制(zhi)定配套文(wen)件。
(十五)強化部(bu)(bu)(bu)門(men)(men)聯動。國(guo)務院生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)(huan)境(jing)主管(guan)(guan)(guan)(guan)部(bu)(bu)(bu)門(men)(men)要(yao)(yao)(yao)會(hui)同(tong)(tong)有(you)(you)(you)關(guan)部(bu)(bu)(bu)門(men)(men)制(zhi)定完善(shan)生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)(huan)境(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)相(xiang)關(guan)政(zheng)策。發展(zhan)改革部(bu)(bu)(bu)門(men)(men)要(yao)(yao)(yao)積極推(tui)動生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)(huan)境(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)成(cheng)果與(yu)國(guo)民經濟(ji)和(he)社會(hui)發展(zhan)相(xiang)關(guan)規劃、區(qu)(qu)(qu)域規劃編(bian)制(zhi)實施(shi)充(chong)分銜接(jie)。自(zi)(zi)然資(zi)(zi)源主管(guan)(guan)(guan)(guan)部(bu)(bu)(bu)門(men)(men)要(yao)(yao)(yao)依(yi)托國(guo)土(tu)空間規劃“一張圖”系統,共(gong)享生(sheng)(sheng)(sheng)態(tai)保護紅線(xian)等(deng)(deng)(deng)數(shu)據,加(jia)強生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)(huan)境(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)方(fang)案(an)與(yu)國(guo)土(tu)空間規劃的(de)銜接(jie),共(gong)同(tong)(tong)做好相(xiang)關(guan)研究及(ji)試點(dian)先行等(deng)(deng)(deng)工(gong)(gong)作。水(shui)(shui)行政(zheng)主管(guan)(guan)(guan)(guan)部(bu)(bu)(bu)門(men)(men)負責(ze)水(shui)(shui)資(zi)(zi)源管(guan)(guan)(guan)(guan)理(li)、水(shui)(shui)域岸線(xian)管(guan)(guan)(guan)(guan)理(li)等(deng)(deng)(deng)有(you)(you)(you)關(guan)工(gong)(gong)作,實施(shi)水(shui)(shui)資(zi)(zi)源差(cha)別化管(guan)(guan)(guan)(guan)理(li),合理(li)控(kong)(kong)制(zhi)水(shui)(shui)資(zi)(zi)源開發利(li)(li)用規模(mo),與(yu)生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)(huan)境(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)聯動。林業和(he)草原主管(guan)(guan)(guan)(guan)部(bu)(bu)(bu)門(men)(men)要(yao)(yao)(yao)加(jia)強各類自(zi)(zi)然保護地(di)管(guan)(guan)(guan)(guan)理(li)與(yu)生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)(huan)境(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)的(de)協調聯動。工(gong)(gong)業和(he)信息化、住房城(cheng)鄉建設、交(jiao)通(tong)運(yun)輸、農業農村等(deng)(deng)(deng)有(you)(you)(you)關(guan)主管(guan)(guan)(guan)(guan)部(bu)(bu)(bu)門(men)(men)要(yao)(yao)(yao)根據職責(ze)分工(gong)(gong),加(jia)強本領域相(xiang)關(guan)工(gong)(gong)作與(yu)生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)(huan)境(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)協調聯動,制(zhi)定行業發展(zhan)和(he)開發利(li)(li)用政(zheng)策、規劃時,應充(chong)分考慮(lv)生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)(huan)境(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)要(yao)(yao)(yao)求,減少(shao)對生(sheng)(sheng)(sheng)態(tai)系統功(gong)能和(he)環(huan)(huan)(huan)境(jing)質量的(de)負面影響(xiang)。有(you)(you)(you)關(guan)部(bu)(bu)(bu)門(men)(men)應出臺有(you)(you)(you)利(li)(li)于生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)(huan)境(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)實施(shi)應用的(de)政(zheng)策,并(bing)推(tui)動生(sheng)(sheng)(sheng)態(tai)環(huan)(huan)(huan)境(jing)分區(qu)(qu)(qu)管(guan)(guan)(guan)(guan)控(kong)(kong)監督執法協調聯動。
(十六)完善法(fa)規標準(zhun)。推動將(jiang)生(sheng)(sheng)態(tai)(tai)環境(jing)分區(qu)(qu)管控(kong)要求(qiu)(qiu)納(na)入(ru)相關法(fa)律法(fa)規制(zhi)定修訂。鼓(gu)勵(li)有立法(fa)權(quan)的(de)地(di)方研究制(zhi)定與生(sheng)(sheng)態(tai)(tai)環境(jing)分區(qu)(qu)管控(kong)相關的(de)地(di)方性(xing)法(fa)規。國務院生(sheng)(sheng)態(tai)(tai)環境(jing)主(zhu)管部(bu)門(men)要會同自然(ran)資源(yuan)主(zhu)管部(bu)門(men)等研究制(zhi)定生(sheng)(sheng)態(tai)(tai)環境(jing)分區(qu)(qu)管控(kong)單元劃分要求(qiu)(qiu)及相關標準(zhun)規范。
(十七)強化(hua)(hua)能(neng)力建設(she)。加強生(sheng)態(tai)環境分區(qu)管控(kong)領域相關(guan)學科建設(she)、科學研(yan)究和人才培養,加快建立專業(ye)化(hua)(hua)隊伍。完善生(sheng)態(tai)環境分區(qu)管控(kong)信息平臺建設(she)。各級財政(zheng)部門要綜合(he)考慮(lv)工作目標和任(ren)務,按照財政(zheng)事權和支出責任(ren)劃分原則落實資金(jin)保障。
(十八)積極宣傳(chuan)引導。將生態環(huan)境(jing)分(fen)區管控納(na)入黨政領導干部教育(yu)培訓內容。加(jia)強宣傳(chuan)解讀,及時總結推廣(guang)正面典(dian)型,曝光反面案(an)例,營造全社會廣(guang)泛關注、共(gong)同參與的良好氛圍。
